Parties
These Terms & Conditions ("Terms") govern services provided by BCMLLC ("Company") to the customer ("Customer").
Services
Company will perform services as described in the written work order, estimate, or invoice.
Payment
Customer agrees to pay the rates and fees shown on the invoice. Payment is due as specified. Late payments may incur interest and collection costs.
Scheduling & Cancellations
Appointments require confirmation. Cancellations or rescheduling must be made at least [number] hours in advance, or fees may apply.
Customer Obligations
Customer must provide accurate information and reasonable access. Secure valuables and remove items that should not be handled.
Risk of Loss / Damage; Disclaimer of Liability
BCMLLC is not responsible for loss, damage, or theft of items that:
Are fragile, perishable, or inherently susceptible to damage
Were pre-existing, concealed, or undisclosed
Result from normal wear and tear, rust, mold, mildew, or vermin
Arise from circumstances beyond Company’s control (acts of God, fire, water, third-party actions)
Customer acknowledges risk exists. Company’s total liability shall not exceed the greater of (i) the amount paid for the service giving rise to the claim, or (ii) [$_____]. Company is not liable for indirect, incidental, consequential, special, or punitive damages.
Insurance
Customer is encouraged to maintain insurance for full value of items.
Indemnity
Customer shall indemnify, defend, and hold Company harmless from claims arising from negligence, failure to disclose, or breach of these Terms.
Dispute Resolution & Governing Law
Disputes will be resolved by [arbitration/mediation]/small claims court in [jurisdiction]. Governed by the laws of [State/Province/Country].
Severability, Waiver & Amendments
If a provision is unenforceable, the remainder remains in effect. Failure to enforce is not a waiver. Amendments must be in writing and signed by both parties.
Entire Agreement
These Terms constitute the full agreement regarding the subject matter.
